Terms of Service

1. Acceptance

By creating an Arioon account, using our API, embedding our SDK, or accessing our website, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, you may not use the service.

If you're agreeing on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" in these Terms refers to that organisation.

2. The service

Arioon provides a skin analysis API and embeddable SDK that processes face images to return parameter scores and AI-generated recommendations. The service is not a medical device, does not provide medical diagnosis, and is not a substitute for professional dermatological advice. Scores and recommendations are for informational purposes and should not be relied on as the sole basis for treatment decisions.

3. Your account

You must provide accurate, current information when you sign up and keep it updated. You are responsible for safeguarding your password and any API keys we issue you. You're liable for activity that occurs under your account; notify us immediately if you suspect compromise.

4. Your end users

If you use Arioon to provide skin analysis to your own end users, you are responsible for:

  • Obtaining your end users' explicit consent to biometric processing before submitting their images to our API
  • Providing your end users with a clear privacy notice that names Arioon as a processor (we provide a model clause)
  • Honouring data-subject rights requests from your end users that flow through to us

Our Data Processing Agreement governs our role as your processor.

5. Acceptable use

Your use of Arioon must comply with our Acceptable Use Policy. We may suspend or terminate accounts that violate it.

6. Fees and billing

Pricing is published on our pricing page. Pricing is in US dollars; local-currency invoicing is available on request for ZAR, NGN, and KES.

You only pay for successfully completed assessments. Failed analyses (face not detected, processing errors) are not billed.

Paid plans require a monthly commitment to the tier's included quota. Usage above the included quota is billed at the per-unit overage rate at the end of each month. Annual subscribers pay 10× monthly upfront for 12 months ("2 months free on annual"); overage continues to invoice monthly.

Invoices are issued on the 1st of each month for the prior period. Payment terms are net 14 days unless otherwise agreed. Late payments may result in service suspension; persistently overdue accounts may be terminated.

7. Cancellation and refunds

You may cancel at any time. Cancellation takes effect at the end of the current billing period; we don't issue partial refunds for unused portions of paid-up time, except where required by law. Annual subscriptions are non-refundable except in cases of material breach by us.

8. Intellectual property

We own the Arioon software, models, calibration data, and documentation. You retain ownership of images and data you submit to us; you grant us a licence to process them solely to provide the service to you.

You may not reverse-engineer, scrape, retrain, or use our service outputs to train competing skin-analysis models.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, or produce results suitable for any particular medical or commercial purpose.

Skin analysis outputs are informational and not medical advice. Always consult a qualified dermatologist for diagnosis and treatment.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIOON'S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold Arioon harmless from claims, damages, and expenses arising out of your use of the service in violation of these Terms, your end users' use of the service, or your violation of any third party's rights.

12. Termination

Either party may terminate this agreement for convenience by providing written notice (email is fine). We may suspend or terminate your account immediately for material breach, non-payment, or violation of the Acceptable Use Policy. On termination, your data is deleted within 30 days unless legal retention obligations require longer.

13. Governing law and disputes

These Terms are governed by the laws of South Africa. Disputes shall be resolved in the courts of Cape Town, unless an enterprise agreement specifies otherwise. Nothing in this clause limits any consumer-protection rights you have under your local law.

14. Changes

We may update these Terms from time to time. Material changes will be notified by email and via a re-acceptance gate on the dashboard. Continued use after the effective date of an updated version constitutes acceptance.
